PRIVACY POLICY

Introduction

For the last 12+ years, actintel, LLC (actintel) has provided comprehensive evidence-based scientific expert mapping identification, mapping, and profiling solutions for pharmaceutical, biopharmaceutical, and medical devices companies for compliant, meaningful, and lasting collaborations throughout the product lifecycle. The results are delivered through a simple easy-to-use but highly versatile scientific expert mapping online web application. The database compiled by actintel on behalf of its clients is derived all or in part from source material in the public domain. The compiled data is delivered via actintel’s web-based tool licensed exclusively to a specific company and their employees throughout the period governed under an agreement and any subsequent extensions, with actintel retaining rights to the software. actintel’s services also cover additional market research services such as qualitative and quantitative surveys, sentiment analysis, insightful research, and data-analytics.

Privacy Rules

actintel is committed to protecting the privacy of its customers. As part of its services actintel collects personal information (e.g., phone, fax, emails, education & training information) on health care professionals through publicly available sources (e.g., scientific associations and medical directories) and government database (PubMed, clinicaltrials.gov) from around the globe including European Union, the European Economic Area and/or United Kingdom to our offices in the United States. In ensuring the highest quality of services actintel operates on the basis of total dedication to professional integrity, commitment, and application of professional methods and standards.

actintel complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. actintel has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. actintel has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Information Collection and its Use

actintel website users and visitors may request additional information about actintel by providing certain personal information, such as name, e-mail address, phone number, portal login ID and password. actintel uses this information to contact the visitor and discuss/conduct the services requested. For example, if a website user or visitor fills out the “Contact Us” form, actintel will use the information provided to contact the user or visitor regarding his/her request.

actintel also obtains non-HR business contact information of health care professionals (including name, job title, company affiliation and contact information) from third party public sources, such as medical associations and directories for use in actintel data products and services. Individuals have the right to know what personal data we possess about them. Individuals can access that personal data by contacting us using the information provided at the end of this document.

Personal Information

actintel does not collect sensitive* personal information. actintel only collects personal information that is needed to provide customer service, authorized access to hosted solution, offer new products, services and product demos to users, or fulfill any legal and/or regulatory requirements associated with the provision of the services.

When actintel collects personal data (such as such as name, e-mail address, phone number, employment, etc.) of EU, Swiss or UK individuals to provide customer service, authorized access to hosted solution, or offer new products and services, actintel will inform the involved individuals the purpose for which the information has been collected and processed, including their right to obtain access to their data, correct inaccurate data, and the right to delete any unlawfully processed data. actintel and all its covered entities is committed to complying with the Data Privacy Framework (DPF) Principles and as enforceable under U.S. Law.

 * “Sensitive Personal Information” means personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual.

Accessing Hosted Solutions

actintel also provides hosted health care professionals software services to its customers in the United States. Customers accessing compiled data from publicly available sources like PubMed and Conference Abstract Indexes in the United States are responsible for managing the data appropriately. These responsibilities include determining the type of information that is stored, how that information will be used, to whom it will be disclosed, and for what purposes.

As a security measure actintel uses software tools to keep track of users, visitors or spurious activities. A snapshot of that data can give us insight into who is logging in at what date and time and to also track web traffic. These software tools may also collect information regarding client access of our hosted solutions and computer network. This data is reviewed and deleted daily and not stored.

Disclosure of Personal Information

actintel is not in the business of selling or sharing information with any entity not directly involved in providing the Services. actintel will never review, share, distribute, print, reference, or disclose any personal information, including any personal information obtained from publicly available sources from the European Union, the European Economic Area, Switzerland, and/or United Kingdom to any third-party other than the customer individual or company who is currently in contract or in the process of contracting with actintel in regard to using actintel products and services. We may be required to release personal information in response to lawful requests from public authorities including to meet national security and/or law enforcement requirements.

Services

actintel is a consulting company whose sole purpose is to standardize and verify information about scientific experts in a meaningful and effective way for our clients. We provide support, consulting, hosting, or other market research services to our customers/clients. Companies hire us for a variety of reasons but primarily clients engage actintel to objectively identify, access, verify, and validate scientific experts and compile information methodically and objectively. We are contracted directly by biopharma, biotech, pharmaceutical and devices companies. We do not become involved in the actual selection of any scientific expert for any specific purpose.

Our Assurance

In ensuring the highest quality of services actintel operates on the basis of total dedication to professional integrity, commitment to real partnership, and application of professional methods and standards. We collect only as much personal information as we need for specific, identified purposes, and we won’t use it for other purposes. We keep the personal information only as long as we need it for the purposes for which we collected it, or as permitted by law. We take all appropriate steps to make sure the personal information in our records is accurate.

We will disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

How We Share Data

We share personal information with our affiliates and researchers/analysts who process personal data on behalf of actintel. This Policy applies to all of our affiliates and contractors who gather and process data from third party public sources on behalf of actintel for use in actintel data products and services.

Onward Transfers to Third Parties

Pursuant to the DPF Principles, actintel is liable for the transfer of EU, Switzerland, and/or UK personal data to third parties acting as our agents unless we can prove we were not a party giving rise to the damages.

Other Covered Entities

In the course of fulfilling our business relationships, we share personal information with our affiliates and researchers/analysts who process personal data on behalf of actintel. This Policy applies to all of our affiliates and contractors who gather and process data from third party public sources on behalf of actintel for use in actintel data products and services.

Access, Consent, Sharing

actintel acknowledges the right of EU, Swiss, and/or UK individuals to access their data that has been transferred into the United States.  actintel provides individuals with reasonable access to their personal information for purposes of correcting, amending, or deleting that information where it is inaccurate or has been processed in violation of the DPS Principles. Upon request actintel will provide individuals with information about whether we hold any of their personal information. To review and update personal information, individuals can contact us at privacy@actintel-usa.com. We will respond to all requests for access, to correct inaccurate data, update information, or delete information within 45 business days.

Individuals have the right to choose (opt out) whether their personal data is (i) to be disclosed to a non-agent third party or (ii) to be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by them. If you wish to opt out, all you need to do is contact us by using the information provided at the end of this document.

We take commercially reasonable physical, technical, and organizational measures to protect health care professionals’ personal information from loss, misuse, unauthorized access or disclosure, alteration, and destruction. We share personal information with our employees and contractors who process personal data on behalf of actintel. We regularly review how we’re meeting these privacy promises.

Authorized Statutory Body

actintel has elected to voluntarily participate in the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-US Data Privacy Framework, and certify its adherence to the EU-U.S., UK, and Swiss DPF Principles (“DPF Principles”). actintel is subject to the investigatory and enforcement powers of the United States Federal Trade Commission (the “FTC”.)

Questions, Concerns, and Complaints

In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-US Data Privacy Framework (Swiss-US DPF) actintel commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the DPF Principles. Independent Dispute Resolution

actintel has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.
